1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of MyScoreMetrics, including our website, accounts, practice questions, assessments, performance tools, study recommendations, educational content, and other features we make available.

By creating an account, purchasing access, or otherwise using MyScoreMetrics, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. About MyScoreMetrics

MyScoreMetrics is an educational platform designed to help nursing students and NCLEX-RN candidates practice nursing questions, review performance, identify areas that may need additional study, and organize their preparation.

Features may include diagnostic assessments, practice questions, performance analytics, focused review, study recommendations, saved questions, notes, and other learning tools.

3. Educational Purpose

MyScoreMetrics is provided for educational and study purposes only. The service does not provide medical, nursing, legal, or other professional advice.

Content on MyScoreMetrics should not be used to diagnose, treat, or make decisions regarding an actual patient's medical care. Clinical decisions should be based on appropriate professional judgment, applicable policies, current clinical standards, and authorized healthcare resources.

4. NCLEX & NCSBN Disclaimer

MyScoreMetrics is an independent educational platform. It is not affiliated with, sponsored by, endorsed by, or operated by the National Council of State Boards of Nursing (NCSBN).

NCLEX and NCLEX-RN are used only to identify the examination for which users may be preparing. References to the NCLEX-RN Test Plan or Client Needs categories are intended to help organize educational material around publicly available examination framework information.

MyScoreMetrics practice questions are independently developed educational materials and are not official NCLEX examination questions. We do not claim to possess or provide confidential, recalled, or secure NCLEX examination content.

5. Accounts

Certain features may require you to create a MyScoreMetrics account. You agree to provide accurate information and to keep your account information reasonably current.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. You should notify us if you believe your account has been accessed without authorization.

Accounts are intended for individual use unless MyScoreMetrics expressly provides a different type of license or account.

6. Subscriptions & Payments

MyScoreMetrics may offer free and paid plans. The features, access period, and price applicable to a purchase will be displayed before checkout.

If a plan automatically renews, the renewal terms, billing frequency, and applicable price will be disclosed during purchase. By purchasing a recurring subscription, you authorize the applicable payment provider to charge the payment method you provide in accordance with those disclosed terms until the subscription is canceled.

Prices and available plans may change. A price change will not retroactively alter a completed one-time purchase. Changes affecting recurring subscriptions will be handled in accordance with applicable law and the terms presented with the subscription.

7. Cancellations & Refunds

Cancellation and refund eligibility will be governed by the terms presented at the time of purchase and any refund or cancellation policy then in effect.

Canceling a recurring subscription generally prevents future renewal charges but does not automatically create a refund for amounts already paid, except where required by law or expressly stated in the applicable purchase terms.

Before paid subscriptions are made available, the applicable billing, cancellation, and refund terms should be reviewed on the Pricing or checkout page.

8. Acceptable Use

You may use MyScoreMetrics for lawful personal educational purposes. You may not misuse the platform or interfere with its operation.

You agree not to:

• Share, sell, rent, or transfer your account to another person.
• Copy or systematically reproduce substantial portions of the question bank or educational content.
• Scrape, crawl, harvest, or automatically extract content or data without authorization.
• Distribute MyScoreMetrics questions, rationales, assessments, or paid materials publicly or commercially without permission.
• Attempt to bypass access controls, subscription restrictions, or security features.
• Upload malicious code or attempt to disrupt the website or service.
• Use the service in violation of applicable law or the rights of another person.
• Use automated systems to create excessive requests or otherwise impair the service.

9. Intellectual Property

MyScoreMetrics and its original content, including practice questions, rationales, explanations, graphics, software, page designs, analytics interfaces, study materials, branding, and other original materials, are protected by applicable intellectual property laws.

Subject to these Terms, users receive a limited, personal, non-exclusive, non-transferable, and revocable right to access the service for their own educational use.

Purchasing access does not transfer ownership of MyScoreMetrics content or grant permission to reproduce, republish, resell, or create unauthorized commercial copies of that content.

10. User Submissions

You may be able to submit messages, notes, feedback, screenshots, support requests, or other information. You remain responsible for information you choose to submit.

Do not submit passwords, full payment card numbers, protected health information, or unnecessary sensitive personal information through general support forms or other fields not specifically designed to receive such information.

If you provide feedback or suggestions about MyScoreMetrics, we may use that feedback to evaluate and improve the service without an obligation to compensate you.

11. Third-Party Services

MyScoreMetrics may rely on or link to third-party services, including payment processors, hosting providers, analytics providers, authentication tools, or external educational resources.

Third-party services may be governed by their own terms and privacy practices. MyScoreMetrics is not responsible for the independent content, policies, or availability of third-party services that we do not control.

12. Service Availability

We work to keep MyScoreMetrics available and useful, but uninterrupted or error-free access cannot be guaranteed. The service may occasionally be unavailable because of maintenance, updates, technical problems, security concerns, or circumstances outside our control.

We may modify, improve, replace, add, or discontinue features as the platform develops.

13. Disclaimer of Warranties

To the extent permitted by applicable law, MyScoreMetrics is provided on an “as is” and “as available” basis. We do not warrant that the service will always be uninterrupted, error-free, or suitable for every user's individual educational needs.

Although we aim to provide useful and accurate educational material, nursing standards, examination frameworks, clinical guidance, and other information can change. Users remain responsible for consulting current authoritative resources when appropriate.

14. Limitation of Liability

To the fullest extent permitted by applicable law, MyScoreMetrics and its owners, operators, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the service.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

15. Suspension or Termination

We may restrict, suspend, or terminate access when we reasonably believe an account is being used in violation of these Terms, to compromise platform security, to infringe intellectual property rights, or to engage in unlawful activity.

Where appropriate, we may provide notice or an opportunity to address the issue before termination.

16. Changes to These Terms

We may update these Terms as MyScoreMetrics changes, new features are introduced, or legal and operational requirements evolve.

When these Terms are updated, the “Last updated” date at the top of this page will be revised. If a change is material, additional notice may be provided where appropriate or required by law.

17. Governing Law

These Terms are intended to be governed by the laws applicable to the operator of MyScoreMetrics, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

The specific governing-law and dispute-resolution provisions may be updated before paid services are launched to reflect the legal entity operating MyScoreMetrics and its jurisdiction.
